JOHNSON, District Judge.
THIS MATTER comes before the Court upon Plaintiffs’ Motion for Review of Agency Action, filed October 1, 2004 (Doc. 19), following oral argument which took place on January 24, 2007. After the hearing, parties were allowed to supplement the briefing, in light of recent case law on the issues raised.
