OPINION
FRANCHINI, Justice.
{1} Defendant Paul Perea appeals from a conviction for contributing to the delinquency of a minor contrary to NMSA 1978, § 30-6-3 (1990) that resulted from his having provided alcohol to a minor. In his appeal to the Court of Appeals, Defendant argued that he should have been charged instead with the offense of selling or giving alcoholic beverages to a minor under a provision of the Liquor Control Act, NMSA 1978, § 60-7B-l(A) (1998).
