GUITTARD, Justice.

After a jury trial the probate court ordered Violet Moss to be confined to a mental hospital for a period of ninety days for “observation and/or treatment.” She appeals, complaining that the provisions of the Mental Health Code concerning temporary hospitalization, and particularly Tex. Rev.Civ.Stat.Ann. arts. 5547-27 to 5547-39d (Vernon 1958 and Vernon Supp.1975), 1 are unconstitutional because they deprive persons of their liberty without due process of law.
