MEMORANDUM AND ORDER

LUNGSTRUM, District Judge.

Plaintiff instituted this diversity action to recover damages for injuries sustained in a car accident allegedly caused by a “phantom” motorist. Presently before the court are defendants Empire Fire & Marine and Lanter Delivery Systems, Inc.’s motion for summary judgment, or, in the alternative, for partial summary judgment (doc. 28) and plaintiff Donald C.
