About 7 o’clock on the evening of February 2, 1895, while the plaintiff and respondent was walking south on the east side of Stevens street» *405between Sprague street and First street, in the city of Spokane, she slipped and fell upon the ice which had accumulated upon the sidewalk and broke the smaller hone of one of her legs near the ankle, and also received internal injuries of a serious nature.
