— Application to the orphans’ court to assign a judge and fix a date for a jury trial of the issue sent by precept of the register of wills to this court.

The Act of August 5, 1941, P. L. 821, 20 PS §1961, amends section 17 of the Register of Wills Act of June 7, 1917, P. L. 415, by authorizing the register in awarding an issue d. v. n. to issue precepts either to the court of common pleas or the orphans’ court of the respective counties.
