Schmoyer, defendant in error, sought and obtained a writ of habeas corpus awarding him the custody of his two and one-half year old son. Plaintiff in error, mother of the child and respondent below, is the divorced wife of Schmoyer. She has remarried and makes her home in Denver with her present husband. Friction marked the domestic life of the parties, and the child was the subject of a great deal of controversy and the cause of apparent ill will between the parents, not unusual in cases of this kind.
