Chapter 565, art. 2, § 36, of the Laws of 1890, provides that “all trains and locomotives on railroads crossing each other at grade shall come to a full stop before crossing, not less than two hundred nor more than eight hundred feet from the crossing and shall then cross only when the way is clear and upon a signal from the watchman stationed at the crossing.” The evidence discloses that the defendant did not comply with the statute, and by reason thereof the accident occurred.
