The main question presented for review in this case is, Did the court err in holding that there was any evidence to establish gross negligence on the part of the defendant ? It appears that the plaintiff and his drover, Mills, took three horses to the depot at Eeedsburg, Wisconsin, about *2378 o’clock in the morning and loaded them into an ordinary box car on one of the sidetracks of the defendant company.
