OPINION AND ORDER

SELYA, District Judge.

This is an action raising intricate questions of administrative law, and is before the Court on cross-motions for summary judgment.

The plaintiff, Joseph Dugan, a seasoned member of the District of Columbia and Rhode Island bars, sought to become a federal administrative law judge (“ALJ”). On November 7, 1980, he filed an application with the Office of Administrative Law Judges (“OALJ”) of the Office of Personnel Management (“OPM”) for placement onto a register from which government agencies fill vacant ALJ positions.
