State v. Davis
Supreme Court of Missouri
1Opinion of the CourtBlair, J.
Defendant was charged with and tried for murder in the first degree for killing Isom Cade. He was found guilty of manslaughter, was sentenced to imprisonment in the state penitentiary for a term of two years and has appealed.
The sufficiency of the evidence to make a case for the jury is not challenged by defendant, except that he contends that the evidence tended to show the defendant \?as guilty of murder in the first or second degree, or not guilty on the ground of self-defense, and that there was no evidence authorizing an instruction upon, or the defendant’s conviction of, manslaughter.
