The appellant was convicted of second degree murder in the Circuit Court of Chariton County on a charge of shooting and killing his paramour, Maxine Miller, on December 13, 1934. The jury assessed his punishment at ten years’ imprisonment in the penitentiary. His motion for new trial below contained nine assignments of error. In his brief on this appeal six of these are expressly abandoned and the cause is- submitted on the sole question whether the evidence was sufficient to support the verdict.
