In its complaint, the plaintiff Patricia Kennedy & Company, Inc. (hereinafter “Kennedy & Co.”) alleged that the defendants Zam-Cul Enterprises, Inc. and Ambulance Systems of America, Inc. (hereinafter collectively “ASA”) had infringed its rights under the federal copyright law and, further, had en gaged in unfair or deceptive practices in violation of Massachusetts General Laws Chapter 93A.
