Appeal *832from a judgment of the County Court of Albany County (Breslin, J.), entered March 16, 1994, upon a verdict convicting defendant of the crime of murder in the second degree.
Following a jury trial, defendant was found guilty of murder in the second degree (see, Penal Law § 125.25 [1]) and acquitted of criminal possession of a weapon in the second degree (see, Penal Law § 265.03), which was the other charge contained in the indictment against defendant and his codefendant, Eric Benson.
