Appellants, Charles F. Leitch and wife, by contract dated August 25, 1965, agreed to purchase from Mitchell H. Latimer .and wife for the sum of $40,000, a 23 acre tract of land in Anne Arundel County located in the middle of several developed subdivisions. There was also a hand written notation on the contract acknowledging the purchasers’ understanding that the Board of Education had expressed an interest in acquiring a portion of the tract.
