Mary Ratkovic brought this action in assumpsit against the Metropolitan Life Insurance Company to recover as beneficiary the face of a policy in that company on the life of her husband, Daniel Ratkovic. The defense was that the insured in his written application for the insurance knowingly made false and fraudulent answers to questions which were essentially material to the risk and that by reason thereof the policy was void.
