Presently before the court is defendant International Union of Operating Engineers’s (“IUOE”) motion for summary judgment pursuant to Rule 56 of the Federal Rules of Civil Procedure. Plaintiff Joseph W. Davis, Inc. (“JWD”) filed this action for declaratory judgment, injunctive relief and damages to set aside a disputed agreement between JWD and IUOE.
