Appeal by the defendant, The Brooklyn Heights Railroad Company, from a judgment of the Supreme Court in favor of the plaintiff, entered in the office of the clerk of the county of Kings on •the 23d day of April, 1898, upon the verdict of a jury for $2,000, •and also from an order entered in said clerk’s office on the 16th day •of May, 1898, denying the defendant’s motion for a new trial made upon the minutes.

The only point raised upon this appeal is that the verdict is against the weight of-evidence. The plaintiff was, at the time of *77the accident, sixty-eight years of age. He was a passenger upon the Fulton street line, and at the junction of Tompkins avenue and Fulton street he alighted from the car, and his description of the accident is given in his testimony as follows: “ When I got to Tompkins avenue I was getting off the car past those two ladies; I got hold of the stanchion with the left hand with my foot on the foot board.
