Aspinwall and others, assignees of the Ohio and Mississippi railroad company, sued Henry JD. Wheeler on a subscription of stock of the following tenor, viz:
“We, whose names are subscribed hereto, do promise to pay to the President and Directors of the Ohio and Mississippi railroad company, the sum of 50 dollars for every share of stock set opposite our names respectively, in such manner, proportions and' times as shall be determined .by said company in pursuance of the charter thereof; Provided, that the payments on the stock shall only be applicable to the construction of said road from…
