This case was formerly before this court from a judgment on demurrer under the style of Pan-American Life Insurance Co. et al. v. Crymes, 169 Miss. 701, 153 So. 803, and the differing views of the judges are set forth therein. It was there held by a majority of the court that if the proof should sustain the allegations as to fraud, the bill would state a cause, and that liability would exist against the surety on the guardian's bond. The cause was remanded for proof on the issue of fraud, and the chancellor held that fraud was proven in that the guardian, at the time he procured an order for…
