MARK R. HORNAK, District Judge.
This matter is before the Court upon Defendant National Casualty Company’s Motion for Summary Judgment. (ECF No. 23). This Court has jurisdiction pursuant to 28 U.S.C. § 1332. For the reasons which follow, Defendant’s motion is denied.
I. Background
On February 4, 2007, Plaintiff Billie J. Brittain (“Plaintiff’) was operating a rental car on State Route 430 in Greenfield Township, Pennsylvania when she was struck by a vehicle operated by Jason Prody (“Prody”).
