BOYLE, DISTRICT Judge:

This suit began as an action by John C. Stewart for damages brought under the Jones Act and the General Maritime Law, including the warranty of seaworthiness, as well as for maintenance and cure against Waterman Steamship Corporation (hereafter Waterman) and against Alcoa Steamship Co., Inc. (hereafter Alcoa) for maintenance and cure only. However, the morning of trial complainant abandoned his claim for damages under the Jones Act and General Maritime Law against Waterman, persisting only in his claim against both respondents for maintenance and cure.
