This is an action in replevin brought by the International Harvester Company of America against Carroll 0. Holley, Sheriff of Lake County, Indiana, to recover possession of a motor truck.

This truck had been taken by the appellee pursuant to a writ of execution issued against the North Shore Fast Freight Service, Inc., at the instigation of a judgment creditor who had obtained judgment on the third day of May, 1935, against said corporation in the Lake Superior Court.
