The plaintiff' in error, S. F. But-try, hereinafter called defendant, was informed against in the -district court of Ottawa county for the offense of receiving and -buying personal property belonging to E. J. Bingham and Geo. 0. Pearson, of the value of $70, knowing it to have been stolen, convicted, and sentenced to the penitentiary for a term of two years. To reverse the judgment rendered he prosecutes this appeal.
