This is an appeal from a judgment pf the Court of Common Pleas of Westmoreland County, Pennsylvania, which judgment was entered after a decree of the court en banc refusing the defendants’ motion for a new trial.

The case was tried in the court of common pleas upon an issue devisavit vel non awarded by the President Judge of the Orphans’ Court of Westmoreland County, to determine the validity of the last will and testament of Anna M.
