FINDINGS OF FACT AND OPINION

EDWARD WEINFELD, District Judge.

In this non jury trial, the defendant is charged with refusal to submit to induction into the Armed Forces of the United States. 1 The defendant appeared at the Induction Center pursuant to a direction from his Local Board, based upon his I-A classification, but refused to comply with the order to take the symbolic one step forward.
