During the early morning hours of June 18, 2005, the victim was shot several times while sitting in the driver’s seat of his parked car in the City of Kingston, Ulster County. After a police investigation, defendant was charged by indictment with attempted murder in the second degree, assault in the first degree, criminal use of a firearm in the first degree, criminal possession of a weapon in the second degree and criminal possession of a weapon in the third degree (two counts).
