The plaintiff-appellant, Linda Jewett, appeals the May 10, 1974 decision of the 'City Court of Binghamton, New York, Small Claims Part, dismissing her cause of action against the defendant, her ex-husband, for support payments allegedly in arrears.

On August 28,1971 the parties entered into a separation 'agreement whereby the defendant husband agreed to pay $40 per week for .support of the children of ithe marriage. The validity of the agreement is not questioned. Paragraph “ 9 ” of the agreement specifically provided that it was to survive a subsequent divorce, to wit: “…
