This cause has been very elaborately argued upon the present appeal, both as to the matters of law and matters of fact, arising in it. The only allegation in the libel, which seems now relied on, is that founded on the act of 1813, c. 34 [2 Story’s Laws, 1352; 3 Stat 51, c. 35]. The fifth section of that act, in substance, provides, that there shall be paid, on the last day of December, annually, to the owner of every vessel, or his agent, that shall be qualified, agreeably to law, to carry on the bank and other cod fisheries, and that shall actually have been employed…
