This matter is before the Court on Defendants KPMG Peat Marwick, Jon C. Madonna, Thomas E. Dailey and George Lambert’s (collectively referred to as “Peat Marwick”) Motion to Dismiss Counts VI, VII and part of Count VIII of the First Amended Complaint filed against them in Allied Investment Corp., et al, v. Gagan, White & Co., et al., (Civ. No. 92-0057-B). The Allied case was subsequently consolidated with this case.
