Estate of Heisserer v. Loos
Missouri Court of Appeals
1Opinion of the Court
REINHARD, Chief Judge.
Bertilla Loos, as executrix, petitioned the court to construe the will of her brother, Michael Heisserer, who died on October 29, 1983. In her petition she asked the court to declare that the interest bequeathed to her deceased sister, Anna Dirnberger, had lapsed. She also requested that the fractional interests in the residuary clause be construed as fifteenths rather than fourteenths. The trial court, after a hearing, determined that Anna Dimberger’s share had not lapsed, and also construed the residuary clause to provide for shares of eighteenths. We affirm.
