1Opinion of the Court
Cox, C. J., and Monks, J.,
are of the opinion that the act of 1907 (Acts 1907 p. 499),,relating to sewers in cities of the State having a population of more than 16,000 and less than 20,000, according to the last preceding United States census, is in violation of the Constitution of this State; that *630the court below should have found for appellant and rendered judgment in his favor, as prayed for in the complaint. The court erred in overruling appellant’s motion for a new trial. The judgment of the court below should be reversed, with instructions to sustain appellant’s motion for a new trial.
