The defendant has appealed from his conviction by a jury on two counts of policy playing in violation of General Statutes § 53-298.

The state’s claims of proof may be briefly summarized as follows: About eight times between

July 17 and July 27, 1963, an officer of the New Haven police department, not in uniform, visited the restaurant where the defendant was employed as a bartender. He observed no signs of gambling.
