The State has applied for leave to appeal from an order of the Criminal Court of Baltimore granting relief under the Uniform Post Conviction Procedure Act and directing a new trial for John Tumminello who was convicted of obtaining money under false pretenses. His first conviction was reversed by this Court in Tumminello v. State, 7 Md. App. 380, 256 A. 2d 342 but he was re-convicted on December 12, 1969. We affirmed his second conviction in Tumminello v. State, 10 Md. App. 612, 272 A. 2d 77, certiorari was denied by the Court of Appeals of Maryland on April 5, 1971 and by the Supreme Court…
