MEMORANDUM OPINION AND ORDER
BABCOCK, District Judge.
Defendant, Maxim Healthcare Services, Inc. (“Maxim”), moves for summary judg ment pursuant to Rule 56. Plaintiff, Gian-ni F. Armani, opposes the motion. The motion is adequately briefed and oral argument would not materially aid its resolution.
