MEMORANDUM OPINION

REGGIE B. WALTON, District Judge.

The plaintiff, Judicial Watch, Inc., brings this action against the United States Department of Justice (“DOJ”) pursuant to the Freedom of Information Act (“FOIA”), 5 U.S.C. § 552 (2006), demand ing the release of records concerning the DOJ’s decision to dismiss civil claims that had been filed against the defendants in United States v. New Black Panther Party for Self-Defense, No. 09-cv-0065 (E.D.Pa.2009). Complaint (“Compl.”) ¶¶ 5, 18-19. Currently before the Court are the parties’ cross-motions for summary judgment.
