MEMORANDUM AND ORDER
VITALIANO, District Judge.
On April 3, 2009, Plaintiff Jewish Community Center of Staten Island (“the JCC”) commenced this action in Supreme Court, Richmond County, against defendant Trumbull Insurance Company *221(“Trumbull”). On May 13, 2009, Trumbull removed the action to this Court under 28 U.S.C. §§ 1441 and 1446, citing diversity of citizenship. (Notice of Removal (Dkt. No. 1)). Substantively, the JCC seeks a declaration that the insurance policy it purchased from Trumbull requires defendant to insure, defend, and indemnify it in an underlying lawsuit filed by the mother…
