In this case, the Government is appealing from the granting of a Motion for Acquittal following a jury verdict finding the defendant herein guilty of obstruction of justice under 18 U.S.C. § 1503. We reverse.

The appellee, the defendant in the court below, Tomas L. Varkonyi, was indicted on four counts. The first three counts charged him with the unlawful transportation of illegal aliens, in violation of 8 U.S.C. § 1324(a)(2). The fourth count charged Varkonyi with corruptly endeavoring to influence, obstruct and impede the administration of justice, in violation of 18 U.S.C. § 1503. The first…
