In this appeal 1 we are called upon to review one order 2 of the district judge. However, the circumstances ultimately producing that order are important to our consideration. In this criminal case the prosecution presented the testimony of a witness who had been permitted to plead guilty to the same offense as charged against the defendant on trial.
