DIXON, Chief Justice.

Appellant Ernest I. Fudge, and his wife, and ten other parties are owners of property in Westchester Estates Nos. 1 and 3, additions to the City of Garland, Texas. As plaintiffs in the trial court, they brought this suit May 17, 1957, for damages, actual. and exemplary, for alleged fraud and breach of contract affecting rights claimed by them as owners of lots contiguous to a former lakesite in Westchester Estates No. 3. In the alternative they pled for title and possession by reliction of respective portions of the former lakesite lying contiguous to their lots.
