The facts in this case are undisputed. During and prior to October, 1925, the Farmers’ Savings Bank of Sherman (hereinafter called the Farmers Bank) was a state bank operating at Sherman, S. D., and the First National Bank of Sherman (hereinafter called the National Bank) was a national bank operating in the same town: These banks had been accustomed -teclear with one another. The latter part of September or first part of October, 1925, a published report of the Farmers’ Bank indicated that its reserve was extremely low and much under the legal limit.
