1Opinion of the CourtBuck, J.
J. G. Clark sued Durwood Bradley under an assignment of the cause of action from R. E. Squires for $100, paid by Squires to Bradley through a mutual mistake. Suit was first filed in the justice court. The entry on the docket in that court shows that it was a “suit for debt for $100.” The memorandum of oral pleadings of the parties in that court, found in the record, shows that plaintiff pleaded for interest on the amount sued for from the time it was alleged the money was paid to Bradley by mutual mistake.
