Lucero, defendant below, is here by writ of error challenging the ruling of the trial court denying defendant’s 35(b) motion (Colo. R. Crim. P.).

On March 11, 1964, the defendant was charged by information with possession of two different types of narcotics, Cannabis, in count one, and Heroin in count two.
