Peter Malin and John Itof were convicted in the criminal court of Cook county upon two separate charges of burglary. Malin was also convicted of an assault with a deadly weapon. Their sentences are to run concurrently. The defendants have sued out this writ of error.

Defendants waived their right to a jury trial and the causes were tried before the court. By three separate indictments, Malin and Itof were charged with the burglary of the dwelling-house of Alvin M.
