This was an action in assumpsit brought by the appellee company, against the appellant company, in the circuit court of Cook county, in which, by agreement of the parties, the appellant, without specific pleadings, interposed a counter-claim or set-off and asked judgment thereon. The appellee, the plaintiff, claimed a balance in its favor of $1369.30 and interest, and the appellant company claimed a balance in its favor of $1410.83.
