MEMORANDUM OF DECISION AND ORDER

GENE CARTER, District Judge.

The Court issued an order sua sponte requesting the parties to file written memo-randa regarding the Court’s jurisdiction over the subject matter of this case. The Plaintiffs, Madelyn and George Huffmire, (“the Huffmires”) in this action assert that the Court has both diversity and federal question jurisdiction. The Defendants (referred to collectively as “Boothbay”) disagree that the Court has either diversity or federal question jurisdiction.
