Appeal from an order of the Supreme Court (Sise, J.), entered January 12, 2000 in *594Hamilton County, which, inter alia, partially granted defendant’s motion for summary judgment.
This action arises out of defendant’s legal representation of plaintiff in an action for a constructive trust brought by Salvatore Miceli against plaintiff in 1989. After Miceli was granted the relief he had requested by an order entered May 28, 1992, defendant timely filed a notice of appeal on plaintiff’s behalf.
