ORDER

LYDON, Senior Judge:

This contract case comes before the court on motions for summary judgment filed by the parties. Defendant’s motion for summary judgment seeks dismissal of *786all four counts of the complaint, whereas plaintiff seeks summary judgment on only one count of the complaint. Plaintiff asserts that factual disputes preclude the granting of summary judgment on the other three counts of the complaint. Upon consideration of the submissions of the parties and oral argument, the court concludes that factual disputes warrant denial of the parties’ motions for summary judgment.
