On December 16, 1965, defendant filed his motion to strike plaintiff’s petition from the files, for *119the reason that said petition was not filed in accordance with law.
While defendant in his memorandum suggests that the issues raised by the petition herein have become moot, we will consider only the reason stated in the motion.
