Prosecution in this case was commenced by affi davit on June 22, 1922, and a warrant of arrest issued thereon returnable before the county court of Pike county. From a judgment of conviction an appeal was taken to the circuit court where conviction was again had, upon a complaint filed by the solicitor, substantially in the language of the' affidavit, charging that the defendant did, without just cause, desert or willfully neglect or refuse to- provide for the support and maintenance of his wife, Rosie • Dickey, she being then and there in destitute and necessitous circumstances, and also…
